By accessing or using the Website or any Mochello product, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.

We may update these Terms at any time by posting a revised version on this page with an updated “Last updated” date. Your continued use of the Services after a change means you accept the new Terms. We will notify registered users of material changes by email where feasible.

B. Eligibility and Accounts

• You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order or create an account. Minors may use the Services only under the supervision of a parent or legal guardian who accepts these Terms on their behalf.
• You agree to provide accurate, current, and complete information when creating an account, and to keep it updated.
• You are responsible for all activity that occurs under your account. Notify us immediately at hello@mochello.com if you suspect unauthorized access.
• Each account is personal and non-transferable. You may not share, sell, or lend your account to another person.

C. Orders, Pricing, and Availability

• All prices are listed in U.S. dollars unless otherwise indicated. Prices do not include taxes or shipping unless stated.
• We reserve the right to change prices, product descriptions, and availability at any time without notice. If we cannot fulfill your order due to a pricing error or stock issue, we will refund you in full.
• Product images are for illustration. Minor variations in color, texture, or packaging may occur between the image and the actual product.
• Placing an order is an offer to purchase. An order is only accepted when we send an order confirmation email or ship the product.
• We reserve the right to refuse or cancel orders at our sole discretion, for example where we suspect fraud, resale without authorization, or abuse of promotional offers.

D. Payments, Taxes, and Refunds

• We accept major credit and debit cards and other payment methods displayed at checkout. All payments are processed by third-party providers; we do not store full card numbers.
• You are responsible for any taxes, duties, or customs fees imposed by your country. International orders may incur import charges that are the buyer’s responsibility.
• All transactions are final once an order ships, except as required by law or as described in our Returns and Warranty section.
• For subscription or prepaid services (if offered), you may cancel before the next billing cycle. Refunds for partial periods are not provided unless required by law.

E. Shipping and Delivery

• Orders typically ship within 2–5 business days. Standard delivery to the United States usually takes 7–15 business days after shipment. International delivery typically takes 10–20 business days.
• A flat $5 shipping fee applies to orders under $50. Orders of $50 or more ship free within the United States.
• Risk of loss and title for physical products pass to you upon delivery by the carrier.
• We are not responsible for delays caused by carriers, customs, weather, or other events outside our control. We will work with you to resolve any delivery issue in good faith.

F. Returns and Warranty

• We stand behind our products. If your Mochello product arrives defective or damaged, contact us within 7 days of delivery at hello@mochello.com with your order number and a description (including photos) of the issue.
• We will, at our discretion, replace the product or refund the purchase price. Return shipping for defective products is the customer’s responsibility unless we caused the defect.
• Products must be returned in their original packaging with all accessories. Products damaged by misuse, unauthorized modification, or accident are not covered.
• Consumables such as sticker paper are not returnable once opened, unless defective at arrival.
• Aside from the above, all products are provided as-is. We do not provide implied warranties beyond those required by law.

G. Use of the Services — What You May and May Not Do

You agree not to:

• Use the Services for any illegal purpose or in violation of any applicable laws.
• Interfere with or disrupt the Website, Companion Services, or our servers.
• Attempt to gain unauthorized access to any account, system, or network.
• Reverse-engineer, decompile, or disassemble any part of the companion hardware or software, except as permitted by law.
• Use the Services to transmit malware, spam, harassment, hate speech, or content that infringes the rights of others.
• Resell, redistribute, or sublicense Mochello products or services without our written permission.
• Use automated tools (bots, scrapers, crawlers) to access the Website beyond reasonable personal use.
• Misrepresent your identity, affiliation, or the purpose of your use.

Violation of these rules may result in termination of your account and legal action where appropriate.

H. AI Companion Behavior

Mochello companions use artificial intelligence to generate conversational responses. Please keep the following in mind:

• Companions are not human — responses are generated by AI and may occasionally be inaccurate, incomplete, or unexpected. They are not professional advice (medical, legal, financial, or otherwise).
• Parental supervision — children should use companions under adult supervision. Parents are responsible for reviewing conversation settings and monitoring use.
• No guarantees — we do not guarantee that AI responses will always be appropriate, accurate, or available. AI services may be interrupted for maintenance or technical reasons.
• User responsibility — you are responsible for what you say to the companion. Do not share sensitive personal information (such as passwords or financial details) during conversations.

I. Your Submissions

If you send us feedback, ideas, or suggestions (“Feedback”), you grant us a non-exclusive, worldwide, royalty-free license to use, modify, and incorporate that Feedback into our products and marketing without compensation to you.

If you post reviews or other public content on the Website, you grant us a similar license to display and distribute that content. You remain responsible for ensuring your submissions do not violate the rights of others.

J. Intellectual Property

All content on the Website — including text, images, logos, product designs, software, and the Mochello name and logo — is owned by Mochello or its licensors and protected by copyright, trademark, and other intellectual property laws.

You may view, download, and print content for personal, non-commercial use. You may not copy, modify, distribute, or create derivative works from our content without our written permission.

K. Termination

You may stop using the Services or close your account at any time. We may suspend or terminate your account and access to the Services at our sole discretion, with or without notice, for conduct that violates these Terms or is harmful to other users, our business, or third parties.

Upon termination, your right to use the Services ends immediately. Sections that by their nature should survive termination — including payment obligations, disclaimers, limitation of liability, and governing law — will remain in effect.

L. Disclaimers

THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE DO NOT WARRANT THAT AI-GENERATED CONTENT WILL BE ACCURATE, APPROPRIATE, OR SUITABLE FOR ANY PARTICULAR PURPOSE.

M. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOCHello AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (USD $100), WHICHEVER IS GREATER.

Some jurisdictions do not allow limitations of liability for certain types of damages. In those jurisdictions, our liability is limited to the extent permitted by law.

N. Indemnification

You agree to indemnify and hold harmless Mochello and its officers, directors, employees, and agents from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your use of the Services, your violation of these Terms, or your infringement of any third-party right.

O. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law principles.

Any dispute arising from or related to these Terms or the Services shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in San Francisco, California, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.

If you are a consumer located in the European Union, you may benefit from any mandatory provisions of the law of your country of residence, and you may bring claims in the courts of your country of residence.

P. General Terms

• Entire agreement — these Terms, together with our Privacy Policy and any order confirmations, constitute the entire agreement between you and Mochello.
• Severability — if any provision is held invalid, the remaining provisions remain in full force.
• Waiver — failure to enforce a provision is not a waiver of that provision.
• Assignment — you may not assign these Terms without our written consent. We may assign these Terms to an affiliate or in connection with a business transfer.
• Force majeure — we are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, pandemics, government action, or carrier failures.
• Headings — section headings are for convenience only and do not affect interpretation.
